On July 1, 2019 Florida passed "Chapter 2019-137, Laws of Florida", that includes a registration process for out-of-state healthcare professionals wishing to use telehealth to provide healthcare services to Florida patients. Are you a healthcare professional licensed outside Florida who wants to use telehealth to provide healthcare services to Florida patients? If so, you must comply with Florida’s telehealth registration requirements, which include appointing a registered agent in the state.
“Telehealth” means the use of synchronous or asynchronous telecommunications technology by a telehealth provider to provide health care services, including, but not limited to, assessment, diagnosis, consultation, treatment, and monitoring of a patient; transfer of medical data; patient and professional health-related education; public health services; and health administration. The term does not include audio-only telephone calls, e-mail messages, or facsimile transmissions.
Health care professionals not licensed in Florida that provide out-of-state health care services via telehealth to Florida patients they must register with the applicable board, or with the Department of Health if there is no board. Per the Florida Board of Medicine website, Health care practitioners with an out-of-state license or certification that falls under section 456.47(1)(b), F.S, qualify for an out-of-state telehealth provider registration number when they meet the following requirements:
A registered agent is a person or entity that is appointed to receive legal and other official documents on behalf of a business or organization. In the context of telehealth, the registered agent serves as a point of contact between the telehealth provider and the state, ensuring that the provider is aware of any legal or regulatory requirements and that any official correspondence from the state is promptly received and addressed.
Florida law requires out-of-state telehealth providers to appoint a registered agent in the state. This requirement applies to any provider of telehealth services, regardless of whether the provider is an individual or an organization. The registered agent must be a Florida-based entity authorized to do business in the state. By appointing a registered agent in Florida, the provider is acknowledging that it is subject to the state's jurisdiction and that it will comply with all applicable laws and regulations. The registered agent will serve as a point of contact between you and the state.
